Under the Tenth Amendment of the U.S. Constitution, states have the right to regulate the practice of medicine.
Even though holistic health practitioners provide alternatives to conventional medicine, they often find themselves caught in the crosshairs of state regulatory agencies who are allowed to determine what qualifies as “practicing medicine.”
And anyone who practices medicine is required by law to have a license.
Unlicensed holistic and alternative providers are at the mercy of the many state regulatory boards such as the medical, massage, counseling, nutrition board, etc. These boards can, and routinely do, declare a provider’s services as activities regulated by that board.
What this means to YOU as a Holistic Health and Wellness Coach: Without a license for your services, you can be fined and shut down at any time by the state. Even if you have proper training and certification to provide your services!
The good news is: We make it EASY to protect your holistic services and get peace-of-mind through our PWA License Program.
In fact, it's exactly what happened to Heather Kokesch Del Castillo and her Holistic Health Coaching business in Florida.
She was providing individualized dietary advice through an online health coaching program and in-person sessions.
Heather argued that the First Amendment protected her right to provide nutritional advice, but the courts said NO. She had even studied and received a certificate in holistic health coaching from the Institute for Integrative Nutrition (IIN) in 2015 while living in California.
Ultimately, she had no legal basis to defend her services and was ordered to shut down her business and pay hefty fines to the state.
And the same thing is happening to Donna Harris, a Health Coach in Mississippi.
She is threatened with 6 months of jail time and $1,000 in fines for offering diet coaching and weight loss tips on Facebook without a license.
From the state’s perspective, Donna was an unlicensed dietician giving nutritional advice — although she clearly stated on her Facebook page and website that she wasn’t one.
